Acceptance of Terms
By using JVS Jobs Online, you are agreeing to comply with the terms
of agreement listed on this page. In addition, you are agreeing
to follow the directions posted on the JVS Jobs Online website and
you understand that the terms of use and the directions are subject
change at any time without notice. Should you object to any term
or condition of these Terms of Use, any guidelines, or any subsequent
modifications thereto or should you become dissatisfied with JVS
Jobs Online in any way, your only recourse is to immediately discontinue
use of JVS Jobs Online.
2. Responsibility for Content
JVS Jobs Online was created to provide a venue whereby Employers
may find job candidates and Job Seekers may find employment opportunities.
Though JVS will make every attempt to ensure appropriate use of
the system, JVS is not accountable or liable for any damage or loss
incurred as a result of the use of JVS Jobs Online. It is the responsibility
of individual user (Job Seeker or Employer) to gauge the authenticity
or legitimacy of a particular job positing or candidate.
JVS does not screen job candidates or employers. By using this system,
you agree to take responsibility for screening and verifying candidates
and employers. Additionally, you agree that it is your responsibility
to verify references and you acknowledge that JVS Jobs Online is
not liable for any problems that may arise after contacting individuals
you found by using JVS Jobs Online.
JVS reserves the right to block or delete any postings listed on
JVS Jobs Online at any time and without notice. Additionally, JVS
reserves the right to remove Job Seekers from the emailed job list
at any time without notice.
JVS does not represent or guarantee the truthfulness, accuracy,
or reliability of communications posted by users or does JVS endorse
any opinions expressed by users. You acknowledge that any reliance
on material posted by other users will be at your own risk.
3.
JVS Site Security Rules
Users of JVS Jobs Online are prohibited from violating or attempting
to violate the security of the JVS Jobs Online system. This includes
(1) logging into a server or account which the user is not authorized
to access, (2) attempting to probe, scan or test the vulnerability
of a system or network or to breach security or authentication measures
without proper authorization, (3) attempting to interfere with service
to any user, host or network, including, without limitation, via
means of submitting a virus to JVS, overloading, "flooding",
"spamming", "mailbombing" or "crashing",
or (4) forging any TCP/IP packet header or any part of the header
information in any e-mail or newsgroup posting. Violations of system
or network security may result in civil or criminal liability. JVS
will investigate occurrences which may involve such violations and
may involve, and cooperate with, law enforcement authorities in
prosecuting users who are involved in such violations.
4.
Specific Prohibited Uses.
JVS may be used only for lawful purposes by individuals seeking
employment and career information and employers seeking employees.
JVS specifically prohibits any use of the Web Site, and all users
agree not to use the Web Site, for any of the following:
- Posting
any franchise, pyramid scheme, "club membership", distributorship
or sales representative agency arrangement or other business opportunity
which requires an up front or periodic payment, pays commissions
only (except for postings that make clear that the available job
pays commission only and clearly describes the product or service
that the job seeker would be selling, in which case such postings
are permissible), requires recruitment of other members, sub-distributors
or sub-agents.
- Sending
unsolicited mail or e-mail, making unsolicited phone calls or
sending unsolicited faxes regarding promotions and/or advertising
of products or services to a user of a JVS Jobs Online.
Taking any action which imposes an unreasonable or disproportionately
large load on JVS Jobs Online's infrastructure.
- Attempting
to decipher, decompile, disassemble or reverse engineer any of
the software comprising or in any way making up a part of JVS
Jobs Online.
- Aggregating,
copying or duplicating in any manner any of the Web Site Content
or information available from JVS Jobs Online.
- Framing
of or linking to any of the Web Site Content or information available
from JVS Jobs Online.
By
using JVS Jobs Online, you agree not to post, email, or otherwise
make available information, code, data, software or images (collectively
"Content"): that is unlawful, harmful, threatening, abusive,
harassing, defamatory, pornographic, libelous, invasive of another's
privacy, or harms minors in any way; that harasses, degrades, intimidates
or is hateful toward an individual or group of individuals on the
basis of religion, gender, sexual orientation, race, ethnicity,
age, or disability; that impersonates any person or entity, including,
but not limited to, a JVS employee, or falsely states or otherwise
misrepresents your affiliation with a person or entity; that includes
personal or identifying information about another person without
that person's explicit consent. that is false, deceptive, misleading,
deceitful, misinformative, or constitutes "bait and switch";
that infringes any patent, trademark, trade secret, copyright or
other proprietary rights of any party, or Content that you do not
have a right to make available under any law or under contractual
or fiduciary relationships. that constitutes or contains "affiliate
marketing," "link referral code," "junk mail,"
"spam," "chain letters," "pyramid schemes,"
or unsolicited commercial advertisement. that advertises any illegal
services or the sale of any items the sale of which is prohibited
or restricted by applicable law, including without limitation items
the sale of which is prohibited or regulated by California law that
contains software viruses or any other computer code, files or programs
designed to interrupt, destroy or limit the functionality of any
computer software or hardware or telecommunications equipment; hat
disrupts the normal flow of dialogue with an excessive number of
messages (flooding attack) to JVS Jobs Online, or that otherwise
negatively affects other users' ability to use JVS Jobs Online;
or that employs misleading email addresses, or forged headers or
otherwise manipulated identifiers in order to disguise the origin
of Content transmitted through JVS Jobs Online. Additionally, you
agree not to:
contact
anyone who has asked not to be contacted; "stalk" or otherwise
harass anyone;
collect personal data about other users for commercial or unlawful
purposes;
use automated means, including spiders, robots, crawlers, data mining
tools, or the like to download data from JVS Jobs Online - exception
is made for internet search engines (e.g. Google) and non-commercial
public archives (e.g. archive.org) that comply with our robots.txt
file
5.
Limitations on service
You acknowledge that JVS is not responsible for the loss or inappropriate
storage of data on the system. It is the user's responsibility to
properly store and save information. JVS may at any time change
the length of time upon which a posting can active and may limit
the frequency by which the user may access they system.
6.
Termination of service
You agree that JVS, in its sole discretion, has the right (but not
the obligation) to delete or deactivate your account, block your
email or IP address, or otherwise terminate your access to or use
of JVS Jobs Online (or any part thereof), immediately and without
notice, and remove and discard any Content within JVS Jobs Online,
for any reason, including, without limitation, if JVS believes that
you have acted inconsistently with the letter or spirit of the Terms.
Further, you agree that JVS shall not be liable to you or any third-party
for any termination of your access to JVS Jobs Online. Further,
you agree not to attempt to use JVS Jobs Online after said termination.
7.
Technical Systems
JVS is not responsible for any damage that may be incurred because
of site outages, technical problems or other malfunctions of technical
systems, regardless of whether such systems are in JVS's control.
8.
User Options
Users may opt-out from receiving JVS Jobs Online at any time by
accessing the email edit section located on the JVS Jobs Online
website and the bottom of the JVS Jobs Online email generated by
the JVS Jobs Online Listserv.
9.
JVS Liability
Your interactions with organizations and/or individuals found on
or through JVS Jobs Online and any other terms, conditions, warranties
or representations associated with such dealings, are solely between
you and such organizations and/or individuals. JVS is not involved
in the actual transaction between employers and candidates. As a
result, JVS has no control over the quality, safety or legality
of the jobs or resumes posted, the truth or accuracy of the listings,
the ability of employers to offer job opportunities to candidates
or the ability of candidates to fill job openings. In addition,
note that there are risks, including but not limited to the risk
of physical harm, of dealing with strangers, foreign nationals,
underage persons or people acting under false pretenses. You assume
all risks associated with dealing with other users with whom you
come in contact through using JVS Jobs Online.
You
agree that JVS shall not be responsible or liable for any loss or
damage of any sort incurred as the result of any such dealings.
If there is a dispute between participants on this site, or between
users and any third party, you understand and agree that JVS is
under no obligation to become involved. In the event that you have
a dispute with one or more other users, you hereby release JVS,
its officers, directors, employees, agents and successors and assigns
in rights from claims, demands and damages (actual and consequential)
of every kind or nature, known or unknown, suspected and unsuspected,
disclosed and undisclosed, arising out of or in any way related
to such disputes and / or JVS Jobs Online. If you are a California
resident, you waive California Civil Code Section 1542, which says:
"A general release does not extend to claims which the creditor
does not know or suspect to exist in his favor at the time of executing
the release, which, if known by him must have materially affected
his settlement with the debtor."
JVS
DOES NOT WARRANT THAT THE JVS JOBS ONLINE SITE WILL OPERATE ERROR-FREE
OR THAT ITS SERVER IS FREE OF COMPUTER VIRUSES OR OTHER HARMFUL
MECHANISMS. IF YOUR USE OF JVS JOBS ONLINE RESULTS IN THE NEED FOR
SERVICING OR REPLACING EQUIPMENT OR DATA, JVS IS NOT RESPONSIBLE
FOR THOSE COSTS. THE JVS JOBS ONLINE WEB SITE CONTENT IS PROVIDED
ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.
JVS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIMS ALL WARRANTIES,
WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY,
FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. JVS MAKES NO
WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS
OF THE WEB SITE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND
LINKS.
10.
Disclaimer of Consequential Damages
IN NO EVENT SHALL JVS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING,
WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS,
OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING
FROM THE USE OR INABILITY TO USE JVS JOBS ONLINE AND THE WEB SITE
CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER
LEGAL THEORY, AND WHETHER OR NOT JVS IS ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES.
11.
Indemnity
You agree to defend, indemnify, and hold harmless JVS its officers,
directors, employees and agents, from and against any claims, actions
or demands, including without limitation reasonable legal and accounting
fees, alleging or resulting from (i) any Content you provide to
JVS (ii) any Content that you use or (iii) your breach of any of
these Terms of Use.
